NidanTM is a brand owned by Healthbyte Technologies Pvt Ltd.  The terms and conditions contained hereinafter (“TERMS OF USE”) are contract agreement between user and Healthbyte Technologies Private Limited. They cover your access and use of the NidanTM system offered by Healthbyte Technologies Private Limited (“Nidan” or “Healthbyte” or “WE” or “OUR” or “US”).  The “Nidan system” includes NidanTM devices, its accessories, associated firmware, software, web and mobile applications, APIs, websites, products, and services.

Any person logging on to or using the Website (even when such person does not avail of any services or system provided by NidanTM (“USER” or “YOU”) shall be presumed to have read these Terms of Use (which includes the Privacy Policy, separately provided on the Website) and unconditionally accepted the terms and conditions set out herein and this constitutes a binding and enforceable agreement between the User and Nidan. NidanTM devices are only designed to give accurate results with accessories provided along with it. We shall not be liable for any damage whatsoever if loss or another injury occurs due to the use of accessories not supplied by us. Devices operated with accessories not supplied by us shall not be covered under warranty.  

Indemnity

You agree to defend, indemnify and hold us harmless against any losses, expenses, costs or damages (including our reasonable attorneys’ fees, expert fees’ and other reasonable costs of litigation) arising from, incurred as a result of, or in any manner related to (1) your breach of the terms of this Agreement, (2) your unauthorized or unlawful use of the website, and (3) the unauthorized or unlawful use of the website by any other person using your IDs.

Entire Agreement

This Agreement, including the Legal and Privacy Policy, and any other notices, policies, rules, or agreements incorporated into this Agreement by reference, contains the entire agreement between you and us relating to the subject matter hereof, and supersedes any other oral or written communications relating thereto. Termination

Your right to access and use the website immediately terminates without further notice upon your breach of this Agreement. We may terminate this Agreement and/or your right to use the website at any time, with or without cause. Upon any termination of this Agreement and/or your access to the website, you must immediately destroy any copies you have made of any portion of the content. Governing Law and Consent to Jurisdiction

Information Collected
There are two general methods that Healthbyte uses to collect information from you online:

Information you provide us
– Personal identifiable information: You can visit our websites without providing any personal information. We may also collect health information about you that you provide by responding to our questions or surveys.

Information automatically collected

Web Server Logs/IP Addresses. An IP address is a number assigned to your computer whenever you access the Internet.
